End User License Agreement (EULA)

1. Apple's Standard EULA

This application is licensed to you subject to the Licensed Application End User License Agreement ("Standard EULA") set forth by Apple, which can be found at:

The terms and conditions of Apple's Standard EULA are incorporated herein by reference and shall apply to your use of Eyeness, except as modified by the additional terms below.

2. Additional License Terms for Eyeness

In addition to Apple's Standard EULA, the following terms apply specifically to Eyeness:

2.1 License Grant

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Eyeness for your personal, non-commercial purposes on any Apple-branded device that you own or control.

2.2 License Restrictions

You may not:

• Distribute or make Eyeness available over a network where it could be used by multiple devices at the same time
• Rent, lease, lend, sell, redistribute, or sublicense Eyeness
• Copy (except as permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Eyeness
• Remove, alter, or obscure any proprietary notice or labels on Eyeness
• Use Eyeness for any commercial purpose or for any public display

2.3 Intellectual Property

Eyeness and all rights, title, and interest in and to the application, including all intellectual property rights therein, are and will remain the exclusive property of Karol Jaworski and its licensors. This license does not grant you any rights to trademarks, service marks, or trade names.

2.4 Updates and Upgrades

We may from time to time develop patches, bug fixes, updates, upgrades, and other modifications to improve Eyeness ("Updates"). Updates may be automatically downloaded and installed without notice. You consent to automatic Updates. You acknowledge that you may be required to install Updates to continue using Eyeness.

2.5 Data Collection and Privacy

Your use of Eyeness is subject to our Privacy Policy. You acknowledge and agree that by using Eyeness, you consent to the collection and use of your information as set forth in the Privacy Policy.

2.6 Disclaimer of Warranties

TO THE EXTENT NOT PROHIBITED BY LAW, EYENESS IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, AND WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

2.7 Medical Disclaimer

EYENESS IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.

3. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of Eyeness and destroy all copies.

4. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California, United States, excluding its conflicts of law rules.

5. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING EYENESS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS EULA AND APPLE'S STANDARD EULA, AND AGREE TO BE BOUND BY THEIR TERMS.
