End User License Agreement (EULA)

1. Agreement Overview

This End User License Agreement ("EULA") is a legal agreement between you and KidSpend for the use of the KidSpend mobile application (the "Application"). This EULA governs your acquisition and use of our software directly from us or indirectly through an authorized reseller or distributor (a "Reseller").

2. Apple's Standard EULA

Important: KidSpend adopts Apple's Standard End User License Agreement for applications distributed through the Apple App Store.

Please review Apple's EULA as it contains important terms and conditions that apply to your use of KidSpend.

3. License Grant

Subject to the terms of this EULA and Apple's Standard EULA, KidSpend grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.

4. License Restrictions

You agree NOT to:

Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Application nor permit the whole or any part of the Application to be combined with or become incorporated in any other software
Decompile, disassemble or reverse engineer the Application or attempt to do any such things
Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of KidSpend or its affiliates, partners, suppliers or the licensors of the Application
Use the Application for any commercial purpose without our express written consent
Distribute or make the Application available over a network where it could be used by multiple devices at the same time

5. Intellectual Property and Ownership

KidSpend shall at all times retain ownership of the Application as originally downloaded by you and all subsequent downloads of the Application by you. The Application (and the copyright, and other intellectual property rights of whatever nature in the Application, including any modifications made thereto) are and shall remain the property of KidSpend.

6. Premium Features

Certain features of the Application may require payment of fees (Premium Features). If you choose to purchase Premium Features:

Payment will be charged to your iTunes Account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
Account will be charged for renewal within 24-hours prior to the end of the current period
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Application, to understand our practices.

Key points regarding data in KidSpend:

All expense data is stored locally on your device
We do not have access to your financial information
Optional iCloud sync is controlled by Apple's privacy policies
You own all data you input into the Application

8. Termination

This EULA agreement is effective from the date you first use the Application and shall continue until terminated. You may terminate it at any time by deleting the Application from your device.

It will also terminate immediately if you fail to comply with any term of this EULA. Upon such termination, the licenses granted by this EULA will immediately terminate and you agree to stop all access and use of the Application.

9. Limitation of Liability

In no event shall KidSpend, and its directors, officers, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, punitive, special or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Updates and Modifications

KidSpend may from time to time provide updates or modifications to the Application. Such updates or modifications may:

Add new features or functionality
Fix bugs or security issues
Improve performance
Modify existing features

Your continued use of the Application after any such update or modification constitutes acceptance of the updated Application.

12. Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of the jurisdiction where Apple's App Store terms apply.

13. Apple-Specific Terms

For applications acquired through Apple's App Store, the following additional terms apply:

This license is limited to use on Apple devices that you own or control
Apple has no obligation to furnish any maintenance and support services
Apple is not responsible for addressing any claims relating to the Application
Apple is a third-party beneficiary to this EULA

15. Acknowledgment

BY INSTALLING AND USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS EULA AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU ALSO ACKNOWLEDGE THAT THIS EULA IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND KIDSPEND REGARDING THE APPLICATION.

This EULA incorporates by reference Apple's Standard End User License Agreement and should be read in conjunction with our Terms of Service and Privacy Policy.
