Terms of Service

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Karol Jaworski ("Company," "we," "us," or "our") concerning your access to and use of the HomeHero mobile application ("App") and related services.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

Eligibility

To use the App, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the App under applicable laws
• If you are under 18, you must have parental or guardian consent to use the App

Parents and legal guardians are responsible for their children's use of the App and must supervise minors' access to and use of the App.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial purposes only
• Access the App's features and functionality as made available to you

Account Registration and Security

Account Creation

To access certain features, you may need to create an account using:

• Email and password
• Google Sign-In
• Apple Sign-In

Account Information

You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

Family Accounts

If you create a family group:

• You are responsible for all family member profiles you create
• You must have permission to add individuals to your family group
• You are responsible for supervising minor users in your family group
• You control and are responsible for your family's data

Acceptable Use

Permitted Uses

You may use the App to:

• Create and manage personal and family tasks
• Track progress, earn XP, and maintain streaks
• Participate in family challenges and duels
• Manage household chores and responsibilities
• Use other features as intended by the App

Prohibited Uses

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon or violate our intellectual property rights or the rights of others
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false or misleading information
• Upload or transmit viruses or malicious code
• Spam, phish, or send unsolicited communications
• Attempt to bypass any security features
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's servers or networks
• Collect or harvest information about other users
• Use the App in any way that could damage or impair our systems
• Resell, rent, lease, or sublicense the App
• Remove any copyright or proprietary notices

User Content

Your Content

You retain ownership of all content you create in the App, including task descriptions, notes, and profile information ("User Content").

License to Your Content

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your User Content solely for the purpose of providing and improving the App's services.

Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent that you have all necessary rights to your User Content.

Subscriptions and Purchases

Subscription purchases are subject to our Subscription Terms and Apple's payment processing terms. All purchases are final and non-refundable except as required by law or as stated in our Subscription Terms.

Intellectual Property Rights

Our Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Karol Jaworski and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

"HomeHero" and related logos are trademarks of Karol Jaworski. You may not use these trademarks without our prior written permission.

Third-Party Services

The App integrates with third-party services including:

• Supabase - Database and authentication services
• RevenueCat - Subscription management
• Google Sign-In - Authentication
• Apple Sign-In - Authentication

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

Disclaimers and Limitations of Liability

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

• The App will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KAROL JAWORSKI BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Karol Jaworski and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your User Content
• Your violation of any third-party rights

Termination

Termination by You

You may stop using the App at any time. You may delete your account by contacting us at karoljaworsky@gmail.com.

Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• At our sole discretion

Effect of Termination

Upon termination:

• Your right to use the App will cease immediately
• You must delete the App from all devices
• We may delete your account and data
• Provisions that by their nature should survive termination will survive

Dispute Resolution

Informal Resolution

If you have any dispute with us, you agree to first contact us at karoljaworsky@gmail.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in English and located in the United States.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

Exceptions

Either party may seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the developer resides, without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Updating the "Last Updated" date
• Posting a notice in the App
• Sending an email notification (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and us concerning the App.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or Internet failures.

Apple App Store Terms

If you access the App through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Karol Jaworski, not Apple
• Apple has no obligation to furnish maintenance and support services
• Apple is not responsible for addressing any claims by you or third parties
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• You must comply with Apple's App Store Terms of Service
